What does arbitration mean?

Arbitration is a form of dispute settlement in which the parties agree that the dispute should not be settled by a state court but is decided by an arbitral tribunal with arbitrators elected by the parties. State courts are often slow, negotiations are public, court fees are high. If you want to avoid all of this, opt for an arbitration panel!

I have been a public notary in Vienna for around 10 years, am chairman of the specialist committee for commercial and corporate law of the Austrian Chamber of Notaries, and have conducted more than 1,000 inheritance proceedings, including inheritance disputes.

As a profound expert on Austrian commercial, corporate and civil law, but also on building contract law, real estate law and inheritance law, I am a suitable arbitrator for domestic disputes, as well as for international cases. You can choose between an ad hoc arbitration board or an institutionalized proceedings at the VIAC of WKO. Arbitration judgments are enforceable like judgments from state courts, often even easier abroad than judgments from state courts.

An outline of an arbitration procedure is as follows:

First, the parties appoint one or more arbitrators by mutual agreement or through an institution - such as the VIAC. To do this, however, the parties must agree to hold arbitration proceedings, unless this agreement is already contained in the contract on which the dispute is based.

After an organizational meeting held by the arbitrator with the parties and their legal representatives, the arbitrator determines the further procedure, such as the submission of the pleadings, oral negotiations, witness hearings, etc., as well as the place and time of the hearing.

After completing these steps and, if necessary, supplementary evidence by the arbitral tribunal or legal statements by the parties, the arbitral tribunal issues the arbitral award.
